With the rapidly rising popularity of CBD oil, along with ongoing changes to the laws, it can be confusing to know for certain if it’s safe to take CBD while working.

Even if there’s zero illegal THC in the product, CBD is not allowed for military, DOD, and some other federal jobs. Regardless of federal or state law, most employers get to make the final decision. Drugs tests don’t specifically test for CBD, however, full spectrum CBD can make you fail.

Can You Get Fired For Using Hemp Oil?

Hemp Seed Oil doesn’t contain CBD, THC, or any other 113 known cannabinoids.

You can buy hemp seed oil at most grocery stores.

Grocery stores will typically put hemp seed oil next to all the other cooking oils.

Since hemp seed oil is made by squeezing the oil from the seeds, there are no questionable ingredients in it.

Other types of common hemp products that should be completely ok to take to work are hemp seeds (whole or shelled), hemp milk, hemp protein powder, hemp granola bars, hemp seed butter, etc.

The only ingredient that might be questionable to use at work are cannabinoids, such as CBD.

Even though there’s a potential you can get fired for taking CBD oil with THC in it, there are lots of opportunity to get a side job in the cannabis industry. Most jobs in the cannabis industry don’t care if you test positive for THC.

Even though CBD may be legal at the federal level, each state and local county can pass and enforce more strict laws.

Idaho CBD law says if there’s detectable amounts of THC, even if it’s less than 0.3% THC, it’s illegal marijuana and you can be prosecuted.

Make sure you double check with your local laws to verify CBD is legal in your state.

Furthermore, even if CBD is technically legal in your state, each individual county’s sheriff and prosecutor can decide what’s enforced at the local level.

After you verify CBD is legal in your state, you might also want to call your local county sheriff and/or prosecutor to verify the legality and whether or not they’re enforcing differently.

Can An Employer Fire You For Using CBD Oil

If your CBD oil contains THC, even in trace amounts, then there’s a possibility that you will have a routine drug test.

Due to President Trump signing the 2018 Farm Bill, hemp CBD oil can have up to 0.3% THC in it, at the federal level.

Even though the federal level allows up to 0.3% THC, different states can have more strict laws and require the CBD oil have zero THC in it — not even trace amounts.

There’s currently no routine test for just the CBD molecule, however, there are more advanced methods of determining the total amount of CBD in your system.

Routine drug tests are looking for the presence of THC in your system, specifically, the metabolite that THC produces after your body processes the THC molecule.

Will Full Spectrum CBD Oil Make Me Fail Drug Test

Since full spectrum CBD oil can contain up to 0.3% THC, there’s a possibility you will fail a routine drug test.

Depending on how much you take and how often, the small amount of the THC molecule in the oil will start to build up in your system over time.

Once the THC builds up enough, the drug test will come back positive and you could fail a drug test.

Can You Get Fired For CBD

If your employer has a specific ban (policy) against you using any and all types of CBD, regardless of whether or not it contains small amounts of THC, then your employer has the power to fire you.

If you’re caught with CBD in the military, then you can be discharged from drug use and/or failure to follow orders.

Since teachers are employed by the government, US Department Of Education, it is at the discretion of your school board and potential other authorities to allow it or not.

Individual districts can determine whether specific substances are legal and can adopt a general ban on CBD on district property.

Between departments of the federal government are slightly different opinions about whether or not CBD is legal at the federal level.

Publish in the Texas Association Of School Boards (TSAB) shows some answers to legal questions about CBD and marijuana in schools.

Critical elements from the document put out by the TSAB warns that some CBD products on the market may have unreliable labeling.

Some CBD products will say they have no THC and upon testing, might test positive to THC.

Other CBD products might not have the amount of CBD it comes to have on the label.

Since marijuana laws are in a constant state of change, complications in the interpretation and the subsequent enforcement of laws in flux can be different depending on your local jurisdiction.

To date, the FDA has only approved one type of CBD product called Epidiolex, and it’s only been approved to help certain rare forms of seizure.

There are several types of CBD products that you can smoke including flower, vape, or dab.

While vaping CBD is much less inconspicuous, pulling out a giant dab rig or smoking a fat CBD flower blunt — may not be appropriate in all work locations.

Even though CBD flowers won’t get you high, it does look and smell like you’re smoking marijuana.

Even if the CBD is compliant by federal law containing less than 0.3% THC, the small amount of THC can cause you to test positive for marijuana.

If you regularly take CBD products, with trace amounts of THC, it can start to build up in your system over time causing you to potentially fail a drug test.

Since CBD does not trigger intoxicating effects, in order to justify drug testing based on reasonable suspicion, your work or school district are required to observe and identify specific behaviors.

Behaviors your employer must observe in order to justify drug testing you based on reasonable suspicion are speech patterns, behavior, general appearance, body odor indicating drug use, and more.

Certain policies require that you provide any information that may influence the drug screening, regardless of why you’re being tested.

Can You Drive If You Take CBD Oil?

The FDA reports it can be dangerous to drive while taking CBD.

Since CBD is biphasic and produces one set of results at lower doses and completely different results at higher doses.

Lower doses of CBD can make you more awake, while higher doses can trigger sleepiness, lethargy, and sedation. 

Before you start driving to and from work while taking CBD, it’s wise to understand what your CBD dosage is best for you — at different times of the day.

How Long Is CBD Detectable In Urine

According to the journal of Chemistry & Biodiversity, CBD was detectable for up to four hours.

CBD requires advanced testing equipment to detect if it’s in your system, whereas THC is tested for in most all basic drug screening tests.

The U.S. Department of Transportation (DOT) CBD policy reports they do “not” test for CBD.

However, the DOT does test for the federally illegal psychoactive THC molecule found in marijuana.

After President Trump legalized hemp in 2018 at the federal level, CBD products were allowed to have up to 0.3% THC.

A lot of CBD products on the market (full spectrum CBD) will contain small amounts of THC and can be detectable in your urine for up to a month or longer.

However, broad spectrum CBD products do not contain THC, not even in trace amounts.

If you’re taking full spectrum CBD oil, it will have THC in it and depending on how much you take regularly — you could fail a drug test because the THC will start to build in your system.

Will Hemp Oil Show Up On A Drug Test

Hemp oil used in cooking is made from the squeezing the oil from the seeds of the hemp plant.

Hemp seed oil doesn’t contain any cannabinoids, such as CBD or THC.

Since hemp seed oil doesn’t contain cannabinoids, there’s no reason for it to show up on a drug test.

However, some CBD oils use hemp seed oil as the base oil.

With some CBD oils potentially slightly misleading you by using labels such as hemp oil or hemp extract oil — you might need to exercise some caution.

Hemp seed oil is very cheap only costing about $20 for a 24 ounce bottle.

If the hemp oil contains cannabinoids, it will cost significantly more  — about $20 per one ounce.

Will CBD Show On A Probation Drug Test

Drug tests are not looking for the CBD molecule or the metabolite of CBD.

Probation drug tests are screening for the metabolite of the THC molecule.

When you’re purchasing your CBD oil, make sure you’re not taking a full spectrum CBD oil because it will contain trace amounts of THC.

Trace amounts of THC in CBD oil can make you fail a drug test.

The best type of CBD oil to take are either broad spectrum or isolate.

Both broad spectrum and isolate CBD oils will not contain the THC molecule, not even in small amounts.

To verify there’s no detectable amounts of THC in your CBD oil, look at the lab report for the specific batch of CBD oil you’re taking.

Just because a CBD brand says it has zero THC or it’s THC free, doesn’t always mean every single batch is going to be 100% clear of any and all traces of THC.

Always double and triple check to make sure your batch of CBD oil is completely free of any detectable amounts of THC.

Will CBD Show On A Military Drug Test

The military is one of the few organizations that explicitly state you are not allowed to take CBD.

According to x, even if the CBD oil has absolutely no detectable amounts of THC in it, the military has put a general ban on any and all CBD products.

However, if you have a specific prescription for CBD, then you’re able to take the CBD as prescribed.

With that being said, regular routine drug tests don’t specifically look for the CBD molecule.

If you do test positive for THC, for any reason, it can end your military career.

The risk is up to you whether or not you want to take CBD against orders.

Can Federal Employees Use CBD Oil 2020?

A bill is currently making its way through Congress (H.R. 1687) that could allow federal employees to take marijuana — if it’s in compliance with state law.

The military and Department Of Defense employees are explicitly ordered to not take CBD, even if it’s derived from hemp and contains zero THC.

NASA also warns employees that CBD products can make you test positive for THC.

However, the Department Of Transportation explicitly states they do not test for CBD.

Police officers are also warned to proceed with caution if you’re going to take CBD.

Just because certain departments make the mention that they don’t test for CBD, doesn’t mean you’re allowed to take CBD in any form whether you’re at work or off duty.

The main concern and warning federal departments are issuing is since most CBD products on the market are not FDA approved, they can contain more THC — even if the label says it’s completely free of THC.

Proceed with caution and realize you may be taking a risk that could cost you your job.

Does CBD make you sleepy, irritable, or less productive?

Yes. If you take too much CBD, it can cause undesirable effects that can affect your productivity in the middle of the workday. 

Taken in low amounts, CBD can help boost your day.

Before taking CBD at work, make sure you know how it affects you throughout the day.

If you take too much CBD during the middle of the work day, it can make you sleepy and lead to irritability, headaches, and result in a loss of productivity.
